The Act primarily applies to England and Wales, with separate legislation in place for Scotland (the Party Wall etc. (Scotland) Act 1996) and Northern Ireland (the Party Wall etc. Act (Northern Ireland) 1997).
The key purpose of the Party Wall Act is to ensure that property owners who wish to undertake specific construction work that could potentially affect shared walls or boundaries (known as party walls) between two properties, or structures located close to the property boundary, do so in a manner that protects the rights and interests of all involved parties. The Act helps to establish clear procedures and responsibilities, minimizing disputes and providing legal recourse in case of conflicts.
The Party Wall Act covers three main types of work:
1. Building a new party wall: Constructing a wall on the boundary between two properties or directly adjacent to the boundary.
2. Cutting into a party wall: Modifying an existing party wall, such as by inserting beams or removing sections.
3. Excavating near a party wall: Digging or carrying out excavations close to a party wall, which may include foundations or other groundwork.
The Act outlines the obligations of building owners who wish to carry out the aforementioned types of work. It specifies that they must serve formal written notices to the affected adjoining owners, providing them with relevant information and allowing them the opportunity to either consent to the proposed work or dissent and seek further action through appointing party wall surveyors.
The Party Wall Act also establishes the role of party wall surveyors who act as independent professionals appointed by the building owners or adjoining owners to resolve disputes, mediate between the parties, and ensure compliance with the Act’s provisions. The surveyors play a crucial role in facilitating communication, determining the scope of work, protecting the interests of all parties involved, and, if necessary, creating legally binding agreements known as Party Wall Awards.
